ALLEN COUNTY ELECTION BOARD POST- 1-30-2014

POLICE OFFICER CANDIDATES USE OF TAKE HOME CARS- DRIVING THEM TO AND FROM CAMPAIGN EVENTS, ( even if "just on the way to or from work, sites, etc)- January 23rd, I filed an election board complaintregarding police officier /candidates for political office. It has been my observation, and several previous election board complaints- ( bender for council; Joyner for sheriff; ; and a hoopla over congresswoman Jill long having police officers in her campaign materials. Since a police officer who is isued a "take- homepolice car"- is always on duty- and required to respond to police calls; AND- even an off-duty police officer can arrest someone/issue a ticket/citration, etc- or while observing a crime in his presence- this calls into question Indiana laws; and local rules about when is a cop on or off duty? when is a cop allowed to use their cop car to drive to and from campaign events, etc? I received a reply from the law firm of Haller/Colvin- signed by COUNTY ATTORNEY JOHN FEIGHNER( who it seems to me by representing a county police officer; as well as being employed by allen county- last i recall could have a conflict of interest, and appears imrpoPer to me)- in which the INDIANA LAW STATUTE- 3-14-16- appears to say that its ok to publish and distribute campaign materials with the campaigning candidate in his uniform. Given the unclear distinction about when a cop is on or off duty, then it follows logically- that wearing the official uniform - is an ON-DUTY JOB FUNCTION( as compared to being off duty- when a cop normally doesnt wear his uniform, while say- mowing his lawn, going shopping on leisure time; or other non- police related, off duty daily life routines. Not to be absurd to point out absurdity- but what would it be called if a police officer wore his uniform while engaged in "50-shades of gray" type marital activities-with official handcuffs, night stick, or other props? seems like a form of disrespect of the same uniform. CONVERSELY- a political candidate- who is not a official police officer- without state issued badge, and so on- the wearing of a accurate police uniform, of the same jurisdiction- could be rightly arrested for impersonating a police officer? or- wearing an official police uniform similar in appearance- of some far away jurisdiction. ? AND- what of Actors- wearing accurate police uniforms, or "flashing" highly accurate appearing police badges in theatrical performances? AND- THE SAME WOULD SEEM TO APPLY AS TO POLICE CARS AS WELL. we have all heard of instances of "wannabe cops"- with motor vehicles that appear to be official police cars- being cited by cops for impersonating police vehicles/cops? or say someone had a highly accurate motor vehicle- which by all cursory appearances seemed to give the impression of a REAL COP CAR? AND- what of stores selling t-shirts that are printed with "sheriff; police; swat; bomb squad, and so on? DOES THAT CONSTITUTE ANY VIOLATION OF LAWS? so my point is- that official police officers who are also political candidates- should be removed from their police cars; during their periods of political activities( such as a cop stopping offf to pick up, or drop off campaign materials "just on my way to or from work"- AND THAT POLICE OFFICER CANDIDATES "take-home cop cars" milage/GPS readings should be recorded, docum,ented, and sworn to by the officer driving said police car- for the reasons i stated above- that the distinction between on duty; and off duty activities and responsibilities that go along with that TAXPAYER ISSUED, AND PAID FOR COP CAR- do on provide for the appearance of impropriety; or result in an "in-kind" contribution to a particular candidates political; campaign.. I therefore ask the election board to NOT DISMISS THIS ELECTION CAMPAIGN COMPLAINT; to request that GOP Gladieux for Sheriff facebook pager; and web site-xyzhttp://gladieux4sheriff.com/ and xyzhttps://www.facebook.com/Gladieux.for.Sheriff scrub their sites of official police uniforms used by candidates in political campaigns; and a statement be issued by coiunty council; or sheriff dept- as to the rights, responsibilities, and statutes with respect to take- home cop cars being driven to and from campaign events.. Mr feighners letter speaks of the terms "recklesslyand/or reckless" - wording in aforementioned Indiana code. well- to repeat a term- "what is "IS"?- what is reckelss/recklessly? AND- lastly- the county attorney- speaks of a police officer being photographed in front of an official police car. so- If a candidate oh- say - was being "theatrical- and dressed as BATMAN"- WITH A SIGN "TAKE A dent out of crime( which a recked cop car would have- dents?- anyway- seriously- a photo- in fromt of a black , tintwindow sheriff's dodge charger( which looks slightly like a plausible BATMOBILE IS very different than someone -a civilian poilitician- in a plausible y official looking county police uniform- photographed by a random cop car parked by a curb; and the same- for a REAL COP, photographed in fromnt of a REAL COP CAR- parked randomly PARKED- or COULD EVEN BE HIS OWN PERSONAL TAKE-HOME COP CAR- like a TOMBSTONE MARSHALL BEING PHOTOGRAPHED BY HIS PERSONAL HORSE?- the point being - that for attorney feighner- to conflate a cop in a photo with a cop car( not his own, or maybe so)- with driving a take home cop car to and from campaign events- is a misdirection.. AND- given the fact that so many police officer candidates for office- are dimly aware of state election laws- i wouls suggest/imply- that said violationbs have ALREADY HAPPENED- AND BY TRACKING GPS; MILAEGE, AND DALIY LOGS- ONE COULD DEdUCE through simple investigation if a violation has or hasnt occured. so in coinclusion- as MAYBERRY SHERIFF BARNEY FIFE IS FOND OF SAYING- "NIP IT IN THE BUD"- correct the violations that i contend have already happened- web sites; facebook pages, published campaign mateirlas that seek legitimacy through the wearing of a police uniform-which gives an unfair advantage to the cop; or a civilian candidate- risking breaking the law- to publish campaign mateirlas - acting a role as a plausdible legitimate police officer- for political speech purposes? I REQUEST THE ELECTION BOARD ENTERTAIN A MEETING already scheduled in the near future- to discuss this issue for establishing again WHAT "IS " IS ( reckless/reckleesly) etc- AND- to set a precedent of guideleines for future campaigns. example- is it improper for FWPD chief- Marty bender- to wear HIS POLICE UNIFORM while presiding over a city council meeting? or for county councilman Kevin Howell to wear HIS former MARINE UNIFORM while on-duty at a county council meeting? I think i have stated what i would say at a duly convened ACEB meeting- aired in public( instead of behind the scenes.  i see you have a scheduled meeting march 14th. that would be fine. i would like to have this issue on the agenda, as its NOT FRIVOLOUS; IM SERIOUS- and- its important, relevant; and addresses an ongoing issue; and confusion over the statute- given the fact that several previous complaints have been filed, and controversey over this issue through out the years past.. thank you for your indulgence in entertaining this discussion.

HERE'S SOME IDEAS FOR REFORM:

hi! I took your advice- filed to run for DEMOCRAT  sheriff ( again. 25,00 fort wayners cant be wrong- even if they are likely strauight DEMOCRAT VOTERS. issues? legalize marijuana- save tax dollars; less govt, more freedom, lower taxes, focus on the truly dangerous, not stoners, weekend social drinkers, taillight/turn signal scofflaws, etc..
1-  use the office to LEGALIZE MARIJUANA IN INDIANA- just like a dozen or more states in the USA; and more across the world.. COLORADO ; CALIFORNIA; AMSTERDAM- seem like nice places; with stoner; and the tax money would fill some INDIANA STATE GOVT GAPS..

1-A-all marijuana confiscated in drug raids - WILL BE LEGALLY SOLD TO COOLORADO ( lol..)- with any PROFITS ACCRUING TO THE POLICE MOTORVEHICLE OPERATIONS /PURCHASING ACCOUNTS.. ( saving tax dollars outside the box..)

2 . NELSON PETERS MONEY PIT-   "A NOUN, A VERB; AND 9-1-1.."( derisive comment about NYC Mayor Guliani)- this issue- the 9-1-1- dispatch center has sat and been talked to death since 1996, or so; then miraculously- the world stood still - about 2 days after i filed for sheriff in 2010.. hmmmm. SINCE THEN,  this center/issue has cost tax payers millions of dollars, hundreds of problems, and the easiest, simpilest thing- busting out the glass between the 2 basement offices( soon to be moved to the ?? 5th? 6th floor of the ED Rousseau POLICE STATE FORTRESS HQ- )-

anyway- MORE AND MORE MONEY WANTED, DISPATCHER LABOR TROUBLES; A NEW 9-1-1- TAX/SLUSH FUND- do we really know where the money is going?

3- stalled talks / no progress on combining the city and county PD into a coordinated/cooperative METROPoLITAN POLICE DEPT- with buy in from New Haven; etc- other safety entities.
Indianapolis envy- is strangely absent with this issue- the IMPD- along with UNIGOV- is the DICK LUGAR GOLDEN GOVT AWARD-  which vaulted him from a mediocre school board member, to average mayor; to Senator- every foreign policy failure in the last 30 yrs has DICKS SIGNATURE/FINGERPRINTS ON IT-  due to his slot on the SENATE FOREIGN RELATIONS COMMITTEE CHAIR.. , hmmmm.

4- JAIL STAFF SAFETY /SECURITY - how many other incidents happen where guards are viciously assaulted, permanently maimed/impaired; and hospitalised ? what can we do to solve the problem- to prevent this kind of incident from happening again. granted- JAILS; PRISONS, THE DOC; JUVENILE JUSTICE SYSTEMS are not happy places- but i watch enough JAIL ( spike- comcast "47"; and MSNBC LOCK-UP- INDIANA- to get some insight on the day to day issues.

5- EDUCATION- KEEPING KIDS FROM EATING PILLS FROM THEIR PARENTS MEDICINE CHEST- and overdosing; ditto for the parents- how to keep kids from getting high on dangerous pharmaceutical drugs- obtained freely; easily, and all to frequently- from adults; and DR FEEL-GOODS  HAPPY PILL EMPORIUMS..

6- FUN FUN FUN-D RAISING- "TASER THE SHERIFF"- 5 BUCKS A TICKET-  money to go to SHERIFF GUN SAFETY/EDUCATION; TARGET RANGE/TRAINING FACILITY AT ADAMS CENTER ( next to MOUNT GIAQUINTA TOXIC WASTE DUMP ..
DONT TASE ME BRO!!! OWWWWWWWRGGGGGGG. THUD( hitting ground, anddrooling on the carpet, while i sit and watch COPS -RELOADED.. ( movie line- agent colson- ironman 2..lol!!)

7- reconstituting sheriffs horse patrol-  TO use for the usual PR;PUBLIC SAFETY USES- CROWD CONTROL;  kids petting the horse; sitting on them; and patrolling the river greenways; ;downtown parks; and the usual historical sheriffs posse/horse patrol missions..

 8- NO MORE BEGGING FOR MONEY TO RUN A PROPER POLICE ORGANIZATION-  its embarassing to seeh the sheriff have to beg the cheapskate;tightwad; miserly tea party county council for basic operating expenses; either raise taxes, or only enforce the most serious of laws.. OR- BE INNOVATIVE-  and OUTFLANK THE  county council; and find the money by other means..

9- such as the hundreds of thousands of money paid to AADP; AND REDWOOD TOXICOLOGY AND FOR WHAT? seems like a good place to find lots of slush money?

10- A REWARD/BOUNTY FOR RATTING OUT CROOKED COPS;POLITICIANS, JUDGES, PROSECUTERS, AND SO ON  - AND ESPECIALLY DOCTORS PRESCRIBING  "HAPPY PILLS"   RECKLESSELY- to everybody; regardless of symptoms, etc.. NO ONE EVER DIED FROM OVERDOSING ON MARIJUANA.. and your corner pot dealer- goes to prison; whjile your DOCTOR FEELGOOD- with a MEDICAL DEGREE  ( from INDIANA UNIVERSITY around here)- gets off with a slap on the wrist; no fines, no prison.. no justice?

11. MOTORISTS- illegal /undocumented residents from elsewhere- who are otherwise law abiding( not out committing felonies, crimes, etc)- who are trying to be good citizens ; and so on- wont be ARRESTED, OR HARASSED ANY WORSE THAN THE REST OF US SAD SACK LIFER HOOSIERS ( lol)- are by our present POLICE.

12- JAIL INMATES WILL BE TREATED IN ACCORDANCE WITH HUMANE LEGAL TREATMENT; AND LAWS; AND NO WORSE THAN pow"S UNDER THE GENEVA CONVENTION.  nO MORE RIPPING OFF INMATES FAMILIES FOR PRICE GOUGING OF necessities, etc- FROM THE ajil commissary; FOOD  will be edible, ; with ample calories; and quality- . A reasonably content Prisoner/Inmate is less inclined to cause trouble than well- an angry ; hungry; irate INMATE..

13. A DECLARED MORATORIUM ON SHERIFF SALES OF PROPERTY/FORECLOSED HOMES- There are over 6500, or so vacant/foreclosed properties  becoming blighted; and a SHERIFF SALE- does nothing to raise the average property tax assessed valuation; home values, or the LOCAL TAX BASE. They create more problems than they fix.  BANKS SHOULD BE REQUIRED TO SELL THESE DISTRESSED PROPERTIES AT FAIR MARKET VALUE; INSTEAD OF DISPOSING OF THEM FOR OFTEN- PENNIES ON THE DOLLAR TO SETTLE BANKRPUTCIES; DUE TO THE ECONOMY; HEALTH CARE BILLS- DUE TO LACK OF AFFORDABLE HEALTH CARE; AND SO ON. BANKS, COLLECTION AGENTS, MORTGAGE COMPANIES; WALL STREET- ARE SHARKS.  why make it any easier for them? they have plenty of resources. IM GOING TO SSTNAD UP FOR THE LITTLE MAN; THE AVERAGE "JOE".

14- INMATE HEALTH CARE-  seems to be a major expense for the local JAIL SYSTEM- there must be innovative ways to maintain minimum health standards; without "breaking the bank". Our present Sheriff; and staff- well- they just dont care. And yes- Jail Inmates- are often not nice people; but they have rights; and many are either mentally deficient; mentally ill; substance addicted- hard drugs; alcohol; and so on. If we treat them aswell- Jesus said about the imprisdoned- maybe they will be able to change their hearts, and minds.. as for the SIMPLY MEAN ; EVIL  inmates- well- they have rights also, under the laws; and the laws have to be followed.   Most Jail Inmates- are simple screw-ups- doing their time- not bad people; just stoners; drinkers, minor petty ante misdemeanors; who casnt afford to buy their way out of jail..

As The law reads- Im Certain that Police Officers as Candidates SHALLDRIVE THEIR PERSONAL VEHICLES- not Publicly owned Police cars to campaign events of any kind.. AND-the reason Im questioning Campaign literature with a Uniformed Photo; is a few years back, congresswoman Jill Long got in trouble for appearing in a campaign commercoial; Literature with a couple of uniformed Police Officers; on e of whom I think I recall was a County Deputy of some kind.. anyway- Please treat this as a potential Election Campaign Law violation...     police department employee, police officer, or firefighter
    Sec. 6. (a) A state police department employee or a police officer
    or firefighter (including a special duty, auxiliary, or volunteer police
    officer or firefighter) of a political subdivision who recklessly:
    (1) solicits votes or campaign funds;
    (2) challenges voters; or
    (3) performs any other election related function;
    while wearing any identifying insignia or article of clothing that is
    part of an official uniform or while on duty commits a Class A
    misdemeanor.
    (b) This section does not prohibit any of the following:
    (1) A state police department civilian employee from voting
    while on duty.
    (2) A police officer or firefighter from voting while wearing any
    part of an official uniform or while on duty.
    (3) An individual described in subsection (a) from consenting
    to a photograph (or other visual depiction) of the individual
    wearing any part of the individual's official uniform appearing
    in an advertisement in support of a candidate or political party.
    (4) An individual from serving as a pollbook holder under
    IC 3-6-6-36.
    (5) A police officer wearing any identifying insignia or article
    of clothing that is part of an official uniform or while on duty
    from serving as an absentee ballot courier appointed under
    IC 3-11.5-4-22.

Shooting the "sheriff" off his horse( figuratively speaking, of course..) wouldnt want you breaking any laws by driving a take home cop car; owned by the public to any campaign events.. As If the Local sheriff has any REAL HORSES  any more.. lol!  We had a nice talk a few years ago- I "Grilled you/peppered you with some questions, and i think your a nice enough guy..
but as a "notorious local outlaw"( in the western movie sense..)- and of course Candidate- well- its my job to annoy you for a while. Its all in fun, I got no beef with you sheriff.. just so you know- were both on the same side- vs the "REAL outlaws" ( and i dont mean the motorcycle gang either, for the record..
