POLICE OFFICER CANDIDATES USE OF TAKE HOME CARS- DRIVING THEM TO AND FROM CAMPAIGN EVENTS, ( even if "just on the way to or from work, sites, etc)- January 23rd, I filed an election board complaintregarding police officier /candidates for political office. It has been my observation, and several previous election board complaints- ( bender for council; Joyner for sheriff; ; and a hoopla over congresswoman Jill long having police officers in her campaign materials. Since a police officer who is isued a "take- homepolice car"- is always on duty- and required to respond to police calls; AND- even an off-duty police officer can arrest someone/issue a ticket/citration, etc- or while observing a crime in his presence- this calls into question Indiana laws; and local rules about when is a cop on or off duty? when is a cop allowed to use their cop car to drive to and from campaign events, etc? I received a reply from the law firm of Haller/Colvin- signed by COUNTY ATTORNEY JOHN FEIGHNER( who it seems to me by representing a county police officer; as well as being employed by allen county- last i recall could have a conflict of interest, and appears imrpoPer to me)- in which the INDIANA LAW STATUTE- 3-14-16- appears to say that its ok to publish and distribute campaign materials with the campaigning candidate in his uniform. Given the unclear distinction about when a cop is on or off duty, then it follows logically- that wearing the official uniform - is an ON-DUTY JOB FUNCTION( as compared to being off duty- when a cop normally doesnt wear his uniform, while say- mowing his lawn, going shopping on leisure time; or other non- police related, off duty daily life routines. Not to be absurd to point out absurdity- but what would it be called if a police officer wore his uniform while engaged in "50-shades of gray" type marital activities-with official handcuffs, night stick, or other props? seems like a form of disrespect of the same uniform. CONVERSELY- a political candidate- who is not a official police officer- without state issued badge, and so on- the wearing of a accurate police uniform, of the same jurisdiction- could be rightly arrested for impersonating a police officer? or- wearing an official police uniform similar in appearance- of some far away jurisdiction. ? AND- what of Actors- wearing accurate police uniforms, or "flashing" highly accurate appearing police badges in theatrical performances? AND- THE SAME WOULD SEEM TO APPLY AS TO POLICE CARS AS WELL. we have all heard of instances of "wannabe cops"- with motor vehicles that appear to be official police cars- being cited by cops for impersonating police vehicles/cops? or say someone had a highly accurate motor vehicle- which by all cursory appearances seemed to give the impression of a REAL COP CAR? AND- what of stores selling t-shirts that are printed with "sheriff; police; swat; bomb squad, and so on? DOES THAT CONSTITUTE ANY VIOLATION OF LAWS? so my point is- that official police officers who are also political candidates- should be removed from their police cars; during their periods of political activities( such as a cop stopping offf to pick up, or drop off campaign materials "just on my way to or from work"- AND THAT POLICE OFFICER CANDIDATES "take-home cop cars" milage/GPS readings should be recorded, docum,ented, and sworn to by the officer driving said police car- for the reasons i stated above- that the distinction between on duty; and off duty activities and responsibilities that go along with that TAXPAYER ISSUED, AND PAID FOR COP CAR- do on provide for the appearance of impropriety; or result in an "in-kind" contribution to a particular candidates political; campaign.. I therefore ask the election board to NOT DISMISS THIS ELECTION CAMPAIGN COMPLAINT; to request that GOP Gladieux for Sheriff facebook pager; and web site-xyzhttp://gladieux4sheriff.com/ and xyzhttps://www.facebook.com/ Gladieux.for.Sheriff scrub their sites of official police uniforms used by candidates in political campaigns; and a statement be issued by coiunty council; or sheriff dept- as to the rights, responsibilities, and statutes with respect to take- home cop cars being driven to and from campaign events.. Mr feighners letter speaks of the terms "recklesslyand/or reckless" - wording in aforementioned Indiana code. well- to repeat a term- "what is "IS"?- what is reckelss/recklessly? AND- lastly- the county attorney- speaks of a police officer being photographed in front of an official police car. so- If a candidate oh- say - was being "theatrical- and dressed as BATMAN"- WITH A SIGN "TAKE A dent out of crime( which a recked cop car would have- dents?- anyway- seriously- a photo- in fromt of a black , tintwindow sheriff's dodge charger( which looks slightly like a plausible BATMOBILE IS very different than someone -a civilian poilitician- in a plausible y official looking county police uniform- photographed by a random cop car parked by a curb; and the same- for a REAL COP, photographed in fromnt of a REAL COP CAR- parked randomly PARKED- or COULD EVEN BE HIS OWN PERSONAL TAKE-HOME COP CAR- like a TOMBSTONE MARSHALL BEING PHOTOGRAPHED BY HIS PERSONAL HORSE?- the point being - that for attorney feighner- to conflate a cop in a photo with a cop car( not his own, or maybe so)- with driving a take home cop car to and from campaign events- is a misdirection.. AND- given the fact that so many police officer candidates for office- are dimly aware of state election laws- i wouls suggest/imply- that said violationbs have ALREADY HAPPENED- AND BY TRACKING GPS; MILAEGE, AND DALIY LOGS- ONE COULD DEdUCE through simple investigation if a violation has or hasnt occured. so in coinclusion- as MAYBERRY SHERIFF BARNEY FIFE IS FOND OF SAYING- "NIP IT IN THE BUD"- correct the violations that i contend have already happened- web sites; facebook pages, published campaign mateirlas that seek legitimacy through the wearing of a police uniform-which gives an unfair advantage to the cop; or a civilian candidate- risking breaking the law- to publish campaign mateirlas - acting a role as a plausdible legitimate police officer- for political speech purposes? I REQUEST THE ELECTION BOARD ENTERTAIN A MEETING already scheduled in the near future- to discuss this issue for establishing again WHAT "IS " IS ( reckless/reckleesly) etc- AND- to set a precedent of guideleines for future campaigns. example- is it improper for FWPD chief- Marty bender- to wear HIS POLICE UNIFORM while presiding over a city council meeting? or for county councilman Kevin Howell to wear HIS former MARINE UNIFORM while on-duty at a county council meeting? I think i have stated what i would say at a duly convened ACEB meeting- aired in public( instead of behind the scenes. i see you have a scheduled meeting march 14th. that would be fine. i would like to have this issue on the agenda, as its NOT FRIVOLOUS; IM SERIOUS- and- its important, relevant; and addresses an ongoing issue; and confusion over the statute- given the fact that several previous complaints have been filed, and controversey over this issue through out the years past.. thank you for your indulgence in entertaining this discussion.
